The Law

Under English Law there is only one ground for divorce - the irretrievable breakdown of the marriage. This ground must be supported by establishing one of the following facts:

The Procedure

If the marriage has 'irretrievably broken down' and one of the five facts applies the divorce shall follow a 5 stage process.

The Timetable

An average uncontested divorce takes between 4 and 6 months from start to finish.

Stage 1 - the divorce papers are prepared and filed with the court to be issued

Once you have completed our online questionnaire and we have received the original or a certified copy of your marriage certificate we will endeavour to prepare your divorce papers and return them to you for your approval the next working day.

Once approved and returned to us, the paperwork and relevant court fee shall immediately be sent to the court to be issued.

Stage 2 - the divorce papers are sent to your spouse

The Court will issue a copy of the petition and any other relevant documents to your spouse.

Within 8 days of receipt your spouse should return to the court a form called an 'Acknowledgement of Service' which accompanies the petition. The form asks your spouse a set of simple questions such as whether they intend to defend the petition.

If your spouse opposes the petition a different procedure applies which cannot be catered for on this online service. If the divorce petition does become defended we will refer you to our 'sister company' The Beavis Partnership LLP.

If the Acknowledgement of Service form is not returned at all, alternative methods of service will need to be considered. This creates delay and additional fees will become payable.

Stage 3 - the Decree Nisi is applied for

If your spouse does not oppose the petition you can apply for the Decree Nisi to be pronounced.

Upon receipt of the Acknowledgement of Service we will complete an Affidavit for you and endeavour to send this to you the next working day. The Affidavit will confirm that the contents of your petition are true. It will also state whether any circumstances (including those relating to the children) have changed since the filing of the petition. There will be a swear fee which can range between £5 and £9. Once returned to us your Affidavit accompanied by the relevant Application will immediately be sent to the court asking for a date to be set upon which your Decree Nisi shall be pronounced.

Stage 4 - the Decree Nisi is pronounced

Once the court have received your Application a District Judge will look through your divorce papers and, if they seem in order, grant a Certificate of Entitlement for the Decree Nisi to be pronounced. We will then advise you of the date fixed for the Decree Nisi. Depending on the Court's diary, the date is likely to be a few weeks after the application is lodged. We will then advise you of the date fixed. Ordinarily no attendance at the court is required for this appointment.

Stage 5 - the Decree Absolute is received

6 weeks and 1 day after the Decree Nisi, you may apply for the Decree Absolute. We will send the relevant application to the court come the appropriate day together with the relevant court fee.

In the event you fail to apply for the Decree Absolute your spouse may apply 4 months from the date of the Decree Nisi.
