A form, known as a Statement of Arrangements for Children, is sent to the court with the divorce petition detailing the arrangements relating to the children. The form includes details of the children's home, school, health, contact with the other parent and what financial arrangements are in place. The law encourages couples to try and agree these arrangements. If agreement is not reached however, this does not prevent the divorce from proceeding.

It is not always easy, for the parents to reach an agreement after a marriage breakdown and therefore the courts can consider making orders in relation to:

  1. Residence which relates to where a child should live.
  2. Contact which outlines when the non resident parent should see a child.
  3. Specific issues such as how a child should be educated, their religion or change of name. This type of order is known as 'Specific Issues Order'.
  4. Preventative action such as preventing a child from being taken out of the country or preventing a parent from attending a child's school. This type of order is known as 'Prohibited Steps Order'.
